Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Artful Mind ("we", "us", "our") governing your access to and use of the Artful Mind mobile and web application (the "App") and website at artfulmind.app (together, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 13 years old (or 16 in jurisdictions that require it) to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to update it promptly if it changes.

We reserve the right to suspend or terminate accounts that misrepresent identity, are inactive for an extended period, or violate these Terms.

2. AI-generated content disclaimer

Artful Mind includes an AI companion that generates creative reflections, prompts, and written content based on your inputs. Important things you should understand:

  • AI output is not professional advice. The reflections and content generated by the AI are for creative and self-reflection purposes only. They are not medical, psychological, therapeutic, or crisis advice. If you need professional help, please contact a qualified professional or use the crisis resources linked in the app.
  • AI can make mistakes. AI-generated content may occasionally be inaccurate, inappropriate, or not useful for your situation. You are solely responsible for how you interpret and act on AI output.
  • No training on your data. We do not use your personal reflections, artwork, or journal entries to train or improve the AI models. Content you submit is processed only for the specific request you make and is handled under our Privacy Policy.
  • Your inputs belong to you. The prompts, artwork, and reflections you provide are and remain your intellectual property.

By using the AI features, you accept these limitations and agree not to hold Artful Mind liable for any action you take based on AI-generated content.

3. Community content rules

The Service includes an anonymous community gallery where you may share artwork and reflections. By sharing content, you agree to the following rules:

  • You retain ownership of anything you share, but you grant Artful Mind a non-exclusive, royalty-free licence to display, host, and moderate that content within the Service.
  • Do not share content that is illegal, hateful, harassing, threatening, sexually explicit, violent, or that promotes self-harm. Do not share content that infringes on anyone else's intellectual property rights.
  • The gallery is anonymous — your name and avatar are not shown — but you must still avoid posting information that could identify you or others without their consent.
  • We moderate the gallery and may remove content that violates these rules without notice. Repeated violations may result in account suspension or termination.
  • You can delete your own community posts at any time. Once deleted, they are removed from public view in accordance with our Privacy Policy.

4. Subscription terms

Artful Mind offers both free and paid subscription plans. Paid subscriptions are processed through RevenueCat and billed by the applicable app store (Apple App Store or Google Play) or by Stripe on the web.

  • Billing. Subscriptions automatically renew for the same duration unless you cancel before the renewal date. You will be charged the applicable fee plus any taxes.
  • Price changes. If we change subscription prices, we will notify you in advance. Price changes take effect at your next renewal after the notice period.
  • Cancellation. You can cancel your subscription at any time through your App Store, Google Play, or Stripe billing portal. Cancellation stops future renewals but does not refund the current billing period unless required by applicable law.
  • Downgrades. If you downgrade from a paid plan to a free plan, you retain paid features until the end of your current billing period.
  • No refunds. Except where required by law or where a refund is granted at our discretion, all subscription fees are non-refundable.

5. User responsibilities

You agree that you will not:

  • Use the Service for any illegal purpose or in violation of any applicable law.
  • Attempt to access, disrupt, or interfere with the Service's servers, networks, or security measures.
  • Use automated scripts, bots, scrapers, or other means to access the Service without our written permission.
  • Impersonate another person or misrepresent your affiliation with any person or entity.
  • Upload or transmit viruses, malware, or other harmful code.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the AI features to generate content that is illegal, harmful, deceptive, or in violation of these Terms.

You are solely responsible for the content you create, upload, or share through the Service and for any consequences that arise from it.

6. Intellectual property ownership

Your content. You retain full ownership of all artwork, journal entries, reflections, and other content you create or upload to the Service ("Your Content"). We do not claim any ownership rights over Your Content. You grant us only the limited rights necessary to host, display, sync, and back up Your Content so the Service can function.

Artful Mind's content. All code, designs, graphics, logos, trademarks, text (other than Your Content), and other materials provided by Artful Mind are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our written permission.

Feedback. If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, royalty-free, worldwide licence to use that feedback to improve the Service without any obligation to compensate you.

7. Account deletion

You may delete your Artful Mind account at any time from within the app (Profile → Delete account). When you delete your account:

  • Your profile, reflections, artwork, check-ins, and community posts are permanently removed from our production systems within 7 days.
  • Encrypted backups are cleared within 30 days.
  • Billing records required for tax and accounting purposes may be retained for as long as legally required.
  • If you have an active subscription, deleting your account does not automatically cancel your subscription. You must cancel separately through your billing provider.

Once your account is deleted, it cannot be recovered. If you have questions about deletion, contact support@artfulmind.app.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive (including intellectual property, disclaimers, and liability limitations) will remain in effect.

9. Disclaimers and limitations of liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Artful Mind and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or personal injury, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms or the Service is limited to the amount you paid us for the Service in the 12 months preceding the claim, or AUD $100 if you have not paid anything.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable consumer law.

10. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms will first be addressed through good-faith negotiation. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

If you are a consumer in the European Union or the United Kingdom, you retain any mandatory consumer protections provided by the law of your country of residence, and you may also bring proceedings in the courts of that country.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 30 days before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.
